Police say 21-year-old grabbed girlfriend by the throat, restricting her breathing during argument

LAS CRUCES - A Las Cruces man is facing a felony charge after police say he grabbed his girlfriend by the throat and restricted her breathing during a domestic dispute.

Josiah Carter, 21, is charged with aggravated battery against a household member (strangulation or suffocation), a third-degree felony.

According to a criminal complaint filed in Doña Ana County Magistrate Court, the incident occurred April 6 at a residence on Desert Drive.

Las Cruces police responded to the home after a report of a domestic disturbance involving Carter and his girlfriend.

Investigators learned that an argument occurred inside the residence before escalating into a physical altercation, according to court records.

Police say Carter grabbed the woman by the throat with one hand, pinned her down on a bed and applied pressure that prevented her from breathing for approximately 15 seconds.

The woman told police that her vision began to go dark during the incident, according to the complaint.

An officer observed red marks around the woman’s neck consistent with strangulation, court records state.

Police also reported that Carter admitted to grabbing the woman by the neck and “choking” her.

Carter was arrested later that night and booked into the Doña Ana County Detention Center.

As of Tuesday, he remained in custody.
