LAS CRUCES - The New Mexico Department of Justice has launched an investigation into Ben Archer Health Centers following reports that the health care provider recently changed its policies to deny treatment to undocumented migrants.

Deputy Communications Director Chelsea Pitvorec confirmed the investigation in a statement, saying the agency is responding to concerns raised by members of New Mexico’s congressional delegation.

“We have received correspondence from members of New Mexico’s congressional delegation related to reports that Ben Archer Health Clinics in New Mexico may have recently modified their policies to deny medical care to individuals based upon their immigration status,” Pitvorec said. “We have opened an investigation into this matter and will take all appropriate steps to ensure that no one is discriminated against based on their national origin and that all health care facilities in New Mexico operate in compliance with state law.”

The investigation follows public scrutiny and calls for action from Sen. Martin Heinrich and Rep. Gabe Vasquez, who urged state and federal authorities to review the clinic’s policies. The health care provider initially faced backlash after patients and advocates reported that some locations were turning away undocumented individuals. Ben Archer Health Centers has since stated it will continue providing care regardless of immigration status, but whether the agency has reversed course remains unclear.

State officials have not provided a timeline for the investigation.
