Court records allege victim was struck multiple times while restrained; prosecutors seek pretrial detention for all three defendants

LAS CRUCES - A man is facing felony charges after police say he struck his ex-boyfriend multiple times with a wooden bat during an attack at a Las Cruces park while two women held the victim down, according to court records.

All three defendants are charged in connection with the incident, and prosecutors have filed motions seeking pretrial detention against them.

According to statements of probable cause, the incident occurred Nov. 20, 2025, at Burn Lake Park, 1855 W. Amador Ave. Court records show the charges were filed April 1, 2026, more than four months after the alleged attack.

The victim told investigators he was sitting in a vehicle with a friend when a white sedan entered the parking lot. He identified the driver as his ex-boyfriend.

Court records state Dale exited the vehicle and punctured the rear tires of the victim’s vehicle and a second vehicle at the scene before leaving. Several minutes later, the sedan returned with Dale and two women, identified as Jacklyn Garcia and Eufemia Villa.

Investigators wrote that the three approached the victim, and Garcia was holding a wooden bat. Dale then took the bat and struck the victim four times — including blows to his ribs, leg and head — nearly causing him to lose consciousness, according to court records.

Court records state Garcia and Villa held onto the victim during the attack, preventing him from leaving.

A witness later reported seeing the victim on the ground near a pool of blood. The victim later sought medical treatment for injuries, including his head wound.

In addition to the assault, Dale is accused of taking a cellphone from another person at the scene, identified in court records as a friend of the victim. Prosecutors have charged Dale with armed robbery in connection with that allegation.

Dale faces charges including armed robbery, aggravated battery against a household member with a deadly weapon, conspiracy and criminal damage to property. Garcia is charged with aggravated assault with a deadly weapon and conspiracy. Villa is charged with conspiracy.

Court filings describe the incident as a coordinated attack tied to a prior relationship.

Separate court records show the victim sought and was granted an emergency protective order in December 2025, alleging he was struck multiple times with a wooden bat during the incident.

The cases remain pending.
